Fresh bid to impeach CEC Gyanesh Kumar: Opposition submits new notice signed by 73 MPs in Rajya Sabha

NEW DELHI: Opposition parties on Friday submitted a fresh notice in Rajya Sabha seeking a motion to remove Chief Election Commissioner Gyanesh Kumar. The notice has been signed by 73 MPs.Congress leader Jairam Ramesh alleged that there are nine specific charges against the CEC on the ground of ‘proven misbehaviour’ and called his continuation as an assault on the Constitution. In a post on X, he wrote: “73 Opposition MPs in the Rajya Sabha have just submitted to its Secretary General a fresh Notice of Motion for presenting an Address to the President of India praying for the removal of Shri Gyanesh Kumar, Chief Election Commissioner of India, on the ground of proven misbehaviour constituted by acts and omissions committed on and after 15 March 2026, within the meaning of Article 324 (5) of the Constitution of India read with Article 124(4) thereof, Section 11(2) of the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023 and the Judges (Inquiry) Act, 1968. There are now nine specific charges against the CEC that have been documented in great detail and that simply cannot be denied or whitewashed away. His continuation is an assault on the Constitution. It is an absolute disgrace that the man continues to be in office to do the bidding of the PM and HM.” Earlier, Trinamool Congress (TMC) MP and spokesperson Derek O’Brien on Monday said that the opposition would move a fresh impeachment notice against the CEC with additional charges. “19 political parties and around 300 MPs had earlier moved an impeachment notice against the CEC. In the coming days, a fresh impeachment notice with additional charges will be brought,” O’Brien told reporters at a press conference in Kolkata.Also Read | Oppn to bring fresh motion to remove CEC Gyanesh Kumar, says TMC’s Derek O’Brien; alleges BJP planning ‘conspiracy’ in Bengal Earlier this month, notices submitted in both Houses of Parliament seeking Kumar’s removal, were rejected by Lok Sabha Speaker Om Birla and Rajya Sabha Chairman, Vice President CP Radhakrishnan.Opposition parties have accused Kumar of ‘partial conduct,’ alleging that he favoured the ruling BJP, particularly in connection with the Special Intensive Revision (SIR) of electoral rolls. The earlier notice, backed by over 193 MPs from multiple opposition parties, cited several charges, including ‘proved misbehaviour’ and concerns over his handling of electoral roll revisions in states such as Bihar and West Bengal.The move comes amid heightened political tensions as first phase of West Bengal assembly elections was conducted on Thursday, where disputes over electoral roll revisions and administrative decisions by the Election Commission have become key flashpoints.Under Article 324(5) of the Constitution, the process to remove the Chief Election Commissioner is similar to that for a Supreme Court judge. It requires a special majority in Parliament and can only be initiated on grounds of proven misbehaviour or incapacity. Once admitted, a committee comprising senior judicial members and a distinguished jurist examines the charges and the CEC is given an opportunity to present a defence before any further proceedings.
