James Cameron sued by ‘Yellowstone’ Q'orianka Kilcher: Alleges he used her face in ‘Avatar’ without permission

He was recently accused by ‘Yellowstone’ star Q’orianka Kilcher of using her face without her permission for a character in his hit film. 36 year old actress Q’orianka Kilcher has alleged that her facial likeness was used as an inspiration for the lead character from ‘Avatar’, Neytiri. Variety reported that the actress has officially filed a lawsuit, alleging that this was done without her consent or acknowledgement. A statement from the official filing reads that “Plaintiff never consented to Defendants’ use of her likeness, either in Avatar or in any related product or promotion.”Kilcher has also named the big studio that has been backing the three ‘Avatar’ films. Allegations include that her face was used for Neytiri’s inspiration through the usage of sketches, sculptures, and HD models. The photo that was used to create the animated character comes from Kilcher’s feature in the film ‘The New World’. She was 14 years old when the film was shot.Neytiri is an animated character in the film, who is originally played by Zoe Saldana through the use of motion sensor costumes and special effects.

The filing also cited that many aspects of the character, including the cheeks, lips, and chin area, were all directly related to Kilcher. A statement from the actress’ legal team read, “What Cameron did was not inspiration, it was extraction. He took the unique biometric facial features of a 14-year-old Indigenous girl, ran them through an industrial production process, and generated billions of dollars in profit without ever once asking her permission. That is not filmmaking. That is theft.”Further on in the report, there are more allegations against the director, including the fact that he gave the indigenous actress a note admitting to his actions. The note allegedly read, “Your beauty was my early inspiration for Neytiri. Too bad you were shooting another movie. Next time.” This note was given to her along with a print of a sketch made by the director, only a while after the first film was released in 2009.Kilcher added in the statement that “I never imagined that someone I trusted would systematically use my face as part of an elaborate design process and integrate it into a production pipeline without my knowledge or consent. That crosses a major line. This act is deeply wrong.”At the time of writing, neither James Cameron nor his official legal team has issued any official statements about the matter. Moreover, the actress is currently seeking compensatory damages, as well as public acknowledgment of the fact that her face was used in the film.
